A federal high court in Kano has nullified the candidature of the Abia State Governor-elect Alex Otti and all the candidates of the Labour Party in Abia and Kano States in the last general election.
Delivering judgement in a suit filed by Ibrahim Haruna -Ibrahim against the Labour Party and the Independent National Electoral Commission, INEC,
Justice Musa Yunusa held that their emergence was not in compliance with the provisions of the 2022 electoral act.
The judge noted that the failure of the Labour Party to submit its membership register to the INEC within 30 days before its primaries renders the process invalid as any party that failed to comply with the provisions of the electoral act cannot be said to have any candidate in an election and cannot be declared winner of an election, and therefore votes credited to the 1st defendant are wasted vote.
It’s on record that the issue of valid nomination is one of the points the APC is raising against Mr Peter Obi in the Presidential Election petition court.
