The Abuja division of the court of Appeal has upheld the July 16 election that produced Ademola Adeleke’s as Governor- Elect, of Osun state, dismissing the decision of the Osun State tribunal which directed that the certificate of return be withdrawn from Adeleke and be issued to former Governor Gboyega Oyetola.
The court upheld the issue of BVAS against Oyetola stating that the Osun state tribunal was wrong to have said there was over voting and only relying on the evidence by the Oyetola and APC, and as such doesn’t prove their case in.any way.
The judge faulted that Oyetola and APC relied only on the data from the back end server and failed to look at the voters register which forms the foundation of the whole electoral process and as such cannot strengthen their allegations of over voting.
On the issue of Jurisdiction, the court resolved in favour of Adeleke stating that according to section 285(8) of the constitution.as amended, the court has every right to entertain the appeal.

The appellate court, in a unanimous decision by a three-member panel of Justices, led by Justice Muhammed Shuaibu, held that Adeleke’s appeal was meritorious.
The court also awarded N500, 000 cost against the All Progressive Congress, APC, and its candidate, Gboyega Oyetola
